1. Agreement and Related Policies
You agree to these Terms when you accept them through a purchase or service agreement that presents them to you. Use of the website is subject to these Terms to the extent permitted by applicable law. Simply visiting the website does not, by itself, constitute acceptance of the separate arbitration agreement.
The Digital Product License governs digital purchases. The Dispute Resolution Agreement contains individual arbitration and class-action provisions, exceptions and a 30-day right to opt out. Arbitration applies only when that agreement has been validly accepted.
See our Privacy Policy, Digital Products Refund Policy, Refund and Cancellation Policy, Shipping and Returns and Coaching Disclaimer. A separately signed service agreement controls its specific service. The Digital Products Refund Policy controls digital refund questions, the Digital Product License controls digital-use permissions, and the Dispute Resolution Agreement controls dispute procedures. Mandatory law takes priority over every policy.
2. Eligibility and Accurate Information
Purchases and individual service agreements must be made by an adult with legal capacity to contract. A parent, guardian, school, agency or organization must provide any required authorization for youth services. You must provide accurate order and contact information and protect any private access links or account credentials.
3. Educational Content and Your Decisions
Our materials, assessments, coaching, mentoring, speaking and faith-grounded content support learning and personal development. They are not individualized medical, mental-health, legal, financial or other licensed professional advice. You remain responsible for your choices and actions. We do not guarantee income, employment, relationships, health, spiritual results or any other outcome. Separate signed coaching terms apply to paid coaching.
4. Purchases, Delivery and Refunds
Product descriptions identify what is included, the price, format and any technical requirements. Payment is processed through the payment provider identified at checkout. We do not obtain your full payment-card number. Digital delivery and lifetime-download support are described in the Digital Product License. Refunds and payment disputes follow the applicable posted refund policy and mandatory law. No term here removes a statutory refund, warranty or payment-dispute right.
5. Intellectual Property
Site content, books, workbooks, assessments, frameworks, graphics, recordings, courses, downloads, names and logos belong to Activate U or the identified rights holder. A digital purchase grants the limited personal-use license described in the Digital Product License, not ownership of intellectual property. You may make the personal copies that license permits. Other reproduction, distribution, public posting, resale, teaching use or derivative exploitation requires written permission unless applicable law permits it.
6. Acceptable Use
Do not attempt unauthorized access, bypass access controls, introduce harmful code, interfere with the site, scrape protected content at scale, impersonate another person, or submit unlawful, threatening, deceptive or infringing material. Do not submit another person's confidential information without authority. Do not use our website or inbox to seek emergency assistance.
7. Your Submissions and Honest Reviews
You keep ownership of material you submit. You authorize us to use it as reasonably necessary to answer your inquiry, provide requested services, fulfill an order, maintain records and protect the service. Public testimonials, stories and marketing uses require separate permission. These Terms do not prohibit honest reviews, lawful criticism, communications with government agencies, or disclosures protected by law.
8. Third-Party Services
External video, payment, social and other services operate under their own terms and privacy notices. We do not control their independent availability, content or security. This does not excuse obligations imposed on Activate U by law or by our express promises to you.
9. Warranties and Availability
We will honor express product descriptions, written commitments and rights provided by applicable law. Subject to those obligations, the website and general educational content are provided as available, without a promise of uninterrupted or error-free operation. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and noninfringement. This disclaimer does not exclude mandatory consumer warranties or remedies.
10. Limits of Liability
To the extent permitted by law, Activate U and its owners, officers, employees and contractors acting on its behalf are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, including lost profits, arising from the website, digital products or services.
To the extent permitted by law, the total aggregate liability of those parties for all claims arising from the same product or service, or the same or related events, will not exceed the greater of US $100 or the amount you paid Activate U for the product or service giving rise to the claims. For claims arising only from free website use, the total aggregate limit is US $100. Bringing multiple claims, naming multiple covered parties, or using different legal theories or proceedings does not increase the applicable aggregate limit.
Subject to the exceptions below, these exclusions and limits apply regardless of the legal theory, including contract, tort or ordinary negligence, and even if a party was advised of the possibility of the loss. They apply only to the extent permitted by applicable law.
These exclusions and limits do not apply to fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any liability or consumer remedy that cannot lawfully be excluded or limited. They do not reduce a refund expressly due under our policies. If your jurisdiction does not permit a limitation, it applies only to the extent that jurisdiction allows. These Terms do not promise immunity from lawsuits.
11. Suspension and Changes
We may restrict use reasonably necessary to address misuse, security issues or a material breach. Paid digital-license and lifetime-access rights are governed by the Digital Product License and cannot be withdrawn merely because the site changes. Material changes will carry an updated date. Revised purchase terms apply prospectively, and material changes to an existing agreement require any notice and consent required by law. We will not retroactively impose arbitration or remove an existing opt-out.
12. Governing Law and General Terms
Georgia law governs to the extent permitted by law, subject to applicable federal law and consumer protections that apply where you live. Disputes follow the separately accepted Dispute Resolution Agreement, if applicable. If a provision is unenforceable, the remaining provisions continue, subject to that agreement's specific severability rules. Failure to enforce a provision once does not waive later enforcement. We may transfer this agreement only if your existing rights and our obligations are preserved. Provisions concerning intellectual property, accrued obligations, warranty disclaimers, liability limits and any validly accepted dispute agreement survive completion or termination to the extent needed to give them effect, subject to their express exceptions and applicable law.
